Agreement to These Terms
These Terms of Service govern your use of Badly in Koi ("the Service"). By using the Service in any way, you agree to be bound by these Terms.
Eligibility
You may only use the Service if you agree to these Terms. If you are a minor, you must have the consent of a parent or legal guardian, and you may not use the Service if you are below the minimum age required by the law of your jurisdiction.
Account Registration
Some features require you to register an account. You are responsible for keeping your registration information accurate and up to date, and for safeguarding your password and any credentials associated with your account.
Guest Accounts
Starting as a guest creates an account tied only to a randomly generated ID, without an email address. Guest accounts are automatically and permanently deleted after one year of inactivity, immediately upon sign-out, or immediately upon account deletion. We bear no responsibility for data lost this way, and coin purchases or subscription entitlements tied to a deleted guest account cannot be restored or refunded. Add an email address in Settings if you want to keep your account.
Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which you agree to by using the Service.
Your Content and Conduct
You are solely responsible for your use of the Service and for any content you post, including messages, photos, and voice messages, and you understand you may encounter content from other users that is inappropriate. We have no obligation to store your content, so back up anything important yourself.
License You Grant Us
You retain ownership of the content you post, but you grant us a worldwide, non-exclusive, sublicensable, transferable, royalty-free license to use, reproduce, and monetize it in connection with operating the Service. This license survives for a commercially reasonable period after you delete content, and we may retain copies of deleted content.
Our Intellectual Property
The software, design, trademarks, and other intellectual property that make up the Service belong to us or our licensors. You may not copy, modify, or reverse-engineer any part of the Service without authorization.
No Liability for Data Loss
We are not responsible for loss or corruption of data caused by communication failures, unauthorized access, system failures, or similar events.
Prohibited Conduct
You may not use the Service to infringe anyone's intellectual property; violate any law or public order and morals; engage in or facilitate criminal activity; harass, impersonate, or violate the rights of others; interfere with or place undue load on the Service; gain unauthorized access or use bots or similar automated means; send spam or unsolicited solicitations; or buy, sell, trade, or exchange coins for real money or other consideration (RMT).
Moderation and Enforcement
We may remove content or suspend or delete accounts we determine, at our discretion, to be inappropriate or in violation of these Terms.
Advertising and Rewards
The Service may display advertising from third parties, including Google AdMob. We are not responsible for damages arising from ads or from third-party sites reached through them. Any rewards earned through advertising can only be used within the Service, cannot be exchanged for cash, and may be changed or discontinued without notice.
Coins and Virtual Currency
Silver Coin and Gold Coin are in-app currencies with no monetary value; they cannot be exchanged, redeemed, or converted into cash or prizes, regardless of whether they were earned for free (sign-in bonuses, rewarded ads, coupons, gameplay) or purchased. Buying, selling, lending, transferring, or trading coins between users or with any third party (RMT) is prohibited under all circumstances. Casino-style mini-games that use chance are for entertainment only, and their outcomes can never be exchanged for real money or prizes; users below the age required to access such features locally may not use them. We may change how coins are earned, their quantities, odds, and rules at any time without notice, and we may confiscate improperly obtained coins and suspend or delete the accounts involved.
Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. Except where caused by our willful misconduct or gross negligence, we are not liable for any damages, and disputes arising from your violation of these Terms are your sole responsibility to resolve, at your own cost.
Changes to the Service and These Terms
We may revise these Terms as needed, and will notify registered email addresses of material changes. We may also modify, restrict, suspend, or discontinue the Service, in whole or in part, at any time and for any reason.
Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute arising from or related to the Service. If any provision of these Terms is found invalid, the remaining provisions remain in full effect.
